Who owns it?
Keep the purchase invoice, bank evidence, finance or lease agreement, insurance material and any evidence showing who paid for and controls the vehicle.
Is it on finance?
Hire purchase, personal contract purchase, lease and ordinary bank-loan purchases create different legal and contractual positions. Describe the finance accurately and keep the complete agreement.
Is it needed for work or study?
Tools and equipment personally used in employment, trade, business, vocation, study or education may be exempt up to the statutory aggregate value limit. The facts and valuation matter.
Where was it found?
A highway, the debtor's premises, another person's land and business premises can raise different issues. Record the exact location.
If the vehicle is clamped or removed
Photograph and video the condition
Record the clamp, notices, location, visible damage, mileage where possible and the time.
Give prompt written notice of ownership or exemption
State the basis carefully and attach documentary evidence. False or speculative claims can damage credibility.
Ask for the enforcement documents and inventory
Request the creditor, case reference, enforcement power, itemised amount, agent identity and removal location.
Protect short court deadlines
Third-party and exempt-goods claims under CPR Part 85 are procedural claims. Removal can trigger a short period for written notice.
Frequently asked questions
Is every vehicle on hire purchase exempt?
Finance may mean the debtor does not own the vehicle outright, but the contractual and legal interest must be examined. Keep the agreement and current settlement information.
Can I remove a clamp myself?
Preserve the clamp and vehicle condition, then use the appropriate ownership, exemption, complaint or court route. Unauthorised interference can create additional legal and practical risk.
How quickly must a third party claim?
CPR Part 85 contains short procedural time limits, including a seven-day limit after removal for certain written claims. Obtain advice immediately rather than relying on a general summary.
