For enforcement action to which the amended Taking Control of Goods Regulations apply, an enforcement agent must generally allow at least 14 clear days after the Notice of Enforcement before taking control of goods. The 2026 changes came into force on 1 May 2026 and do not retrospectively alter enforcement action already taken.

Identify the creditor, court or authority, reference, amount and the power said to authorise enforcement.
The date and method of notice
Keep evidence of when and how it arrived. Distinguish the posting date from the delivery date when calculating time.
The payment deadline
Check the precise date and time stated. Seek advice before the deadline where identity, liability, vulnerability or affordability is disputed.
Free debt-advice information
The 2026 amendments require the notice to include information about free debt advice and the possible debt-adviser request for an extended notice period.
The 28-clear-day extension
A qualifying debt advice provider may request an extension before the original notice period expires. The extension is available in qualifying cases and excludes non-eligible business debt. Contact an accredited free debt-advice service promptly where this may assist.
Frequently asked questions
Is 14 days the same as 14 clear days?
Fourteen clear days excludes the day on which the period begins and the day of the event. Service and business-day rules may also affect the calculation, so calculate the deadline from the documents and current rules.
Do I automatically receive 28 clear days?
The 2026 amendment allows a debt advice provider to request an extension to at least 28 clear days in qualifying cases. The extension excludes non-eligible business debt.
Does a missing notice automatically cancel the debt?
The debt and the lawfulness of a particular enforcement step are separate questions. The available remedy depends on the enforcement power, evidence and procedural route.
